UNISTELLAR takes every precaution to respect your privacy and ensure the protection of your personal data when using the UNISTELLAR Application (“the App”).

This Personal Data Protection Policy (the “Privacy Policy”) has been developed to inform you about how we collect and process your personal data (“Data”) in connection with the use of the App.

EU Regulation 2016/679 of the European Parliament and Council of April 27, 2016, on the protection of individuals with regard to the processing of personal data and the free movement of such data (hereinafter “GDPR”) sets the legal framework applicable to the processing of personal data.

In accordance with applicable regulations, the purpose of this Privacy Policy is to inform you of the collection, use, and more generally the processing of your personal data by UNISTELLAR.

For the purposes of this Privacy Policy, it is understood that:

“The App” refers to this mobile App and its various functionalities.

“We” or “Unistellar” refers to UNISTELLAR SAS, 5 Allée Marcel Leclerc, 13008 Marseille, France, registered with the Marseille Trade and Companies Register under number 812 339 356.

“User” refers to the person using the App.

 

PURPOSE

The purpose of this Policy is to indicate the type of data we collect and how we use it in order to inform Users in a transparent, understandable, and concise manner in accordance with Article 12 of the GDPR.

No user data is processed if it does not relate to personal data collected by or for our services, processed in connection with our services, or if it fails to comply with the general principles of the GDPR.

 

WHAT PERSONAL DATA WE PROCESS

 We only collect personal data that is necessary for the purpose for which it is processed.

The collection form that appears when you sign up or when your information is updated indicates whether or not the communication of the information is mandatory.

The following data is collected:

  • Identification data and contact details related to your communication with Unistellar, such as your first name, last name, and email address. This data is collected only with your consent when you provide it in order to obtain information from Unistellar, such as when you contact our team as part of a request for information or support, when you answer a questionnaire or enter a competition, or when you sign up to receive Unistellar’s newsletter or current promotional offers.
  • Information collected from Unistellar products: In order for you to use the service, the App connects to the Telescope’s wifi, and the App is linked to the respective Telescope’s model and serial number. We will collect information on your use of smart products (e.g. date and place of activation), their responsiveness, and any errors you may encounter while using the product. This data is necessary for Unistellar to properly monitor the commercial relationship or to provide you with the appropriate technical support, if necessary, after product activation.

– Geolocation data:

This data is used to:  provide you with the appropriate service for your use of the App, namely to:

  • calculate the position of the various celestial objects near you;
  • provide you with appropriate technical support, if necessary;
  • provide you with technical data related to taking photographs with the Telescope.
  • This data can also be used for general statistics.

Geolocation is required when logging in for the first time. Knowing your location will allow us to understand the environmental conditions under which your smart product is operating and thus optimize product performance.

  • Connection data, such as information about your smartphone or tablet’s hardware and software, as well as data related to its connection to a wifi server so that the telescope can use the internet. This information includes your IP address, device type and model, browser type, and device identification. This information is used for the proper functioning of the App and the telescope, to maintain its quality and for general statistical purposes, and to meet our legal and regulatory obligations.

All or some of this personal data is obtained when you:

  • Use the App particularly by means of the information you provide directly and by using its various functionalities;
  • Supply this information through the App;
  • Send us comments or questions; and more generally,
  • by any other means by which you may contact us.

 

PURPOSES FOR WHICH WE PROCESS YOUR PERSONAL DATA

The legal basis will depend on the type of information involved and the specific context, but in principle, we collect information only: a) when we need it to provide the service to you; b) when you have given us explicit consent for such processing; c) when it satisfies our legitimate interest such as for compliance or security; or d) when we must comply with a legal obligation.

Regarding the consent-based purposes, the User may withdraw their consent at any time.

The personal data we collect is processed in accordance with applicable regulations in order to meet explicit, legitimate, and determined purposes.

These purposes include:

  • Allowing you to benefit from the services offered by the App

We collect and use your personal data so that we can provide the services we offer through the App. Specifically, this data is processed to:

  • Ensure the provision of the services provided by the App and the use of the telescope, in particular the service allowing you to save your images (gallery) and participate in the scientific community by sharing your discoveries;
  • Allow the telescope to connect to the internet through the WiFi network;
  • Allow us to offer the Services best suited to your interests;
  • Provide technical assistance or support;
  • Establish statistics on your use of the Telescopes.

In addition to this data, the use of certain Services of the App requires that you authorize the telescope’s geolocation services. Geolocation is necessary for the implementation of several Services offered by the App and particularly in the processing of data when capturing images by means of the Telescope.

The use of geolocation data is necessary for the purpose of providing the service offered by the App. Celestial objects may not be suggested for observation by the User if the Telescope cannot be located. The scientific value of the images captured using the Telescope is also based on the location of the Telescope. The collection of the Telescope’s geolocation when taking pictures is kept within the picture taken for strictly scientific purposes. Location data is used solely for the purpose of calculating the position of various celestial objects near you and providing you with the service in connection with the App.

Before you use the App for the first time, you are asked if you wish to grant your express prior consent to be geolocated. You may, at any time, waive your permission to be geolocated by changing your device settings. To do this, simply change the settings by following the relevant procedure based on your manufacturer and the version of your system installed. However, the service’s functionality will be reduced without access to geolocation data. The collection of geolocation data is essential for the proper functioning of the service.

If you opt out of sharing location data initially or at a later date, you will no longer be able to use all the service’s features.

Given the variety of devices and operating systems available, we recommend consulting your device’s instructions when you wish to change these settings.

The main legal bases for this processing are to enable the implementation of the General Terms and Conditions and, when necessary, your consent.

  • Communicating with you to inform you about our services and to manage our relationship with you

Your personal data is also essential to us for our interactions with you, particularly in the context of your use of the App or any request for assistance. We may notify you of the products and services we offer, provided that we have obtained your prior consent to receive such information through notifications. We may also use your information to conduct surveys and send questionnaires.

You can turn off notifications if you no longer wish to receive special promotional information, advertisements, or other messages from us. For technical reasons, we need a reasonable period of time to satisfy your request, and you may receive a few messages before your request is fully processed.

To maintain and improve the quality of our services, such as to understand how our services are used, we also compile general statistics that are anonymized when the processing of your personal data does not appear necessary for their completion.

The main legal bases for this processing are your consent and our legitimate interest.

  • Securing the App

We secure your personal data—as well as the personal data of third parties—against any fraudulent access, use, or disclosure by implementing enhanced data protection through the use of appropriate physical and logical technical security measures in order to guarantee the integrity of your data, as well as its confidentiality and security.

However, we remind you that no security system is infallible, and we cannot guarantee that your information is completely secure.

The main legal basis for this processing is our legitimate interest.

In the context of the operation of the App, we are bound by various legal and regulatory obligations involving the retention of your personal data. This data may also be used as part of operations to identify the authors of illegal content.

RECIPIENTS OF PROCESSED PERSONAL DATA

We process your personal data exclusively for the purposes described in this Privacy Policy.

The information is intended only for authorized employees of Unistellar.

However, we may share it with trusted partners acting as subcontractors so that we can provide you with all the services offered by the App.

As such, we may share it with:

  • trusted partners acting as subcontractors so that we can provide you with all the services offered on the App, particularly to host your data, to assist you in the use of the App, or to help us carry out statistical analyses; or
  • trusted partners acting for scientific and research purposes as part of the development of our services.

The geolocation data attached to the images may be used for research purposes by Unistellar and its scientific partners. Under no circumstances may geolocation data be used to identify or locate specific persons. In other words, geolocation data is only used in conjunction with other raw data extracted from images for analytical and scientific purposes in relation to observed astronomical objects.

In any event, these third parties are contractually prohibited from using the personal data we transmit to them for any purpose other than that for which they were mandated, and they are required to maintain the security and confidentiality of your information with equal or greater protection than we implement.

We will only disclose your personal data without notice if:

  • Applicable regulations so require;
  • Such disclosure is necessary to comply with applicable laws or regulations, legal proceedings, and/or an administrative or judicial injunction;
  • Needed to protect and defend our rights or property or that of our partners; or
  • More generally, to act urgently in order to protect the personal safety of users of the Site or third parties.

 

JOINING OUR SCIENTIFIC COMMUNITY

Through the App, you also have the option of joining the “Scientific Community” to share and highlight your discoveries with Unistellar and its scientific partners. In order to join this Community, you will be required to provide some personal data, such as your last name, first name, and email address. This data will be used for scientific communications. For more information about how your data is collected and processed, refer to the Scientific Community’s Privacy Policy provided when you sign up.

Joining the Scientific Community is a free and voluntary act on your part, and your use of the App is in no way conditional on your affiliation with this Community.

 

HOW LONG WE KEEP YOUR DATA

We retain your personal data for only as long as is necessary for the purposes described in this Privacy Policy, unless law requires that your data be kept for a different period of time.

Depending on the type of data, your data can be deleted when you wish, whether at your request or automatically, or it can be kept longer if required by law.

The geolocation data issued by the telescope is stored anonymously in order to establish general statistics on your use of the product.

Geolocation data associated with a picture taken is kept for as long as necessary so that we can provide you with the associated service—without allowing for a user to be identified—for scientific and research purposes.

Login data is not stored beyond the time periods recommended by the CNIL.

 

TRANSFER OF YOUR DATA OUTSIDE THE EUROPEAN UNION

As part of the provision of services and the operation of the App, we may transfer your personal data to countries that are not members of the European Union and that have not been the subject of a protection adequacy decision by the European Commission.

When this happens, we ensure that such a transfer is carried out in accordance with applicable regulations by taking all appropriate measures in accordance with legal, technical, and operational conditions to ensure the confidentiality and security of your data.

 

YOUR RIGHTS AND HOW TO EXERCISE THEM

In accordance with applicable regulations, you have a right to access, object to, rectify, and erase your personal data and to limit its processing and portability, and you may define how your data will be used in the event of your death, subject to the legal and regulatory obligations that would require us to keep it. The exercise of some of these rights may prevent us from providing you with access to the App and/or using some or all of the services offered therein.

  • Right of access: Users have a right of access allowing them to ask Unistellar if data concerning them is being processed. Users may request a copy of their personal data that is being processed.
  • Right of rectification: Any User has the right to request the correction of inaccurate or incomplete information concerning them.
  • Right of erasure: Any User may request that their data be erased.
  • Right of portability: Users have the ability to retrieve a portion of their data in an open and readable format.
  • Right to define how data will be used in the event of your death: Users are advised that they have a right to formulate a directive regarding the retention, erasure, and disclosure of their data after their death.

You have the right to file a complaint through the French Commission Nationale de l’Informatique et des Libertés (CNIL), the supervisory authority in charge of compliance with personal data obligations.

Finally, we may be required to communicate your personal data to a duly authorized judicial or administrative authority under the conditions provided for by law.

 

INFORMATION SECURITY

 The security of your data is very important to us, and we are committed to taking all necessary precautions to prevent that information from being modified, erased in error, or accessed by unauthorized third parties. We have put physical and technical security measures in place to keep your information secure.

In the event of a personal data breach, Unistellar will notify the CNIL under the terms provided for by the GDPR.

If such breach poses a high risk to users, Unistellar will provide the affected users with the necessary information and recommendations.

 

UPDATES TO THIS PRIVACY POLICY

We may make changes to this Privacy Policy at any time, particularly if we change our services or if applicable regulations require us to do so. These changes will then apply to personal data collected after the effective date indicated in the Privacy Policy, and we will notify you through a notice on the App or any other means.

As such, we recommend that you review this Privacy Policy on a regular basis for the latest information on our privacy practices.
